Direct Care Workers Senate Bill 1676 and Companion House Bill 7053 As filed, the legislation would have allowed non-nursing staff providing eating assistance to nursing home residents to count toward compliance with minimum nursing staffing standards. The bills would have allowed each nursing home to determine its minimum nursing staffing standards. As amended, the legislation authorizes a nursing home facility to use paid feeding assistants, but prohibits the facility from counting paid feeding assistants’ time toward compliance with minimum nursing staffing standards. See HB 607 for final bill analysis. Health Care Practitioners House Bill 607 The legislation is the final vehicle for the provisions of the progenitor bills, SB 1676 and HB 7053 (direct care workers). AARP’s amendatory efforts contributed to those direct care bills being identified as a vehicle for expansion of scope of practice for several professions. he legislation is now Chapter No. 2020-009, Laws of Florida, effective July 1, 2020. HB 607 does the following: • Permits autonomous primary/midwifery practice for Advanced Practice Registered Nurses (after meeting specified qualifications). • Specifically, it does not permit any reduction in the minimum nursing staffing standards for nursing homes. AARP was a leader in the charge to defeat attempts to eliminate those minimum standards. • Permits licensed nurses to delegate some tasks to Certified Nursing Assistants in home health settings and under specific conditions. Long-Term Care House Bill 1373 and Companion Senate Bill 1544 The legislation will permit the Secretary of the Florida Department of Elder Affairs to determine which priority levels of wait-listed applicants for long-term-care home-and-community-based services will no longer require annual reassessments. Historically, those applicants assessed at levels 1 and 2 (i.e., those needing the least assistance) were rarely placed into those services, obviating the need for the annual reassessments. It also allows a community care-for-the-elderly service provider to dispute a referral by Adult Protective Services. The legislation is now Chapter No. 2020-46, Laws of Florida, effective July 1, 2020.

Genetic Information for Insurance Purposes House Bill 1189 and Companion Senate Bill 1564 The legislation prohibits life and long term care insurers from canceling, limiting, or denying coverage and from establishing differential premium rates based on genetic information. The legislation is now Chapter No. 2020-162, Laws of Florida, effective July 1, 2020.

Automated Pharmacy Systems House Bill 59 and Companion Senate Bill 708 The legislation authorizes community pharmacies to dispense medicinal drugs through the use of Automated Pharmacy System (APS) located outside of the pharmacies. It also requires the APS systems to provide live video or tele-conferencing counseling by pharmacists at the time of dispensing. The legislation is now Chapter No. 2020-124, Laws of Florida, effective July 1, 2020.

Alzheimer's Disease House Bill 835 and Companion Senate Bill 1542 The legislation requires state agencies to provide assistance to the Alzheimer’s Disease Advisory Committee, and creates a position of Dementia Director within the Florida Department of Elder Affairs. It also revises incentive-funding criteria for memory disorder clinics. The legislation is now Chapter No. 2020-45, Laws of Florida, effective July 1, 2020.

Assisted Living Facilities House Bill 767 and Companion Senate Bill 402 The legislation updates regulatory requirements for Assisted Liv- ing Facilities (ALF). Notably, the original bill deleted reporting of adverse incidents until 15 days after an incident. AARP objected to this change. In the final bill, ALFs must report adverse incidents to the Florida Agency for Health Care Administration within 1 business day. The legislation is now Chapter No. 2020-68, Laws of Florida, effective July 1, 2020.
