Eligibility Requirements for Licensure

§ The land upon which the facility is situated meets the definition o f Indian Lands. § The building is o f sound physical structure w ith adequate and safe plumbing, electrical, heating, coo ling, and ventilation system s in place and operational. § Facility is equipped w ith security and surveillance equipment and is capable o f physically securing property and assets. § The facility has been inspected by the TGRA fo r on-go ing public health and safety compliance w ith adopted codes and standards. § Facility is maintained in an o rderly, clean, and neat condition, bo th inside and outside the prem ises. § The facility has been inspected by qualified building and fire inspecto rs and determ ined to be in compliance w ith adopted codes and standards. § The facility has procedures in place fo r emergency preparedness.

EPHS Attestation Certification

§ It is required pursuant to 25 C .F.R . § 559.4 that a tribe list all the EPHS laws, codes, po licies, standards, and procedures adopted and enfo rced to ensure compliance fo r the purposes o f determ ining each gam ing facility operates in a manner that ensures the pro tection o f the environment and the public health and safety. § Emergency Preparedness – List all fire codes and standards adopted, the emergency services utilized fo r fire, ambulance, and po lice pro tection, including any MOU w ith state, city, or county agencies, and approved po licies and procedures. § Food and Water – List all approved po licies and procedures utilized, all codes and standards adopted for food handling and water quality, and the treatment facility o f the supplied water source. § Construction and Maintenance – List all building, plumbing, and electrical codes and standards adopted, and any pro fessional inspection reports or companies utilized to inspect the facility.
