HERE ARE 3 THINGS YOU NEED TO KNOW FILING A LONG-TERM DISABILITY CLAIM?

Few things are more devastating than being denied disability insurance claim. You think you have a financial safety net beneath you in case you’re ever rendered unable to work — only to have it tugged out from under you at the worst possible moment. This can create an especially dire situation if your disability will keep you from your job for an extended period of time. But you can take steps to prevent this from happening. Know What Kind of Insurance You Have When filing for long-term disability, it’s important to know the nature of the insurance company you are dealing with. A policy you purchased independently will present a different case than one you obtained through your employer. Specifically, employer-sponsored insurance falls under the Employee Retirement Income Security Act (ERISA), a set of strict rules and regulations that, arguably, benefit insurance companies far more than policy holders. Under ERISA, the smallest error can be used as an excuse to deny your claim outright. In these cases in particular, it helps to have an expert eye making sure all your paperwork is in proper order. Consult an Expert Disability Lawyer Regardless of whether your claim is governed by the ERISA, you should seriously consider consulting a disability attorney who knows the system well. Because insurance companies can use

mistakes in your filing as justification for a denial, having an extra pair of eyes go over the paperwork with you can make an enormous difference. Know That a Denial Isn’t the End Even well-put-together benefits claims can get denied the first time. In these instances, you still have options in front of you. Depending on the circumstances of your denial, you could pursue an appeal, or even litigation. You can stand up for the benefits that should have been granted to you. Of course, it helps to have an experienced legal team by your side. The appeals process, especially as governed by ERISA, is deeply complex. In fact, some would say the odds are stacked against those seeking to overturn a denied claim. An attorney with a successful track record of appeals can even the odds.
