 Management reserves the right to adjust the penalty but not to exceed the maximum allowable corrective action than what is specified in the preceding pages for a particular offence if warranted.  Imposition of any of the preceding penalty is without prejudice to the institution of appropriate criminal and/or civil action against the parties concerned.  Offences committed will be treated individually and separately even if they fall under the same class of offences.  Management reserves the right to take appropriate action(s) for acts or omissions committed by an employee who, though not specifically listed herein, are similar or analogous thereto, in accordance with the foregoing rules and regulations and the applicable laws. Any department of the Hotel may formulate and implement its own policies and rules of conduct specific to their operational requirements in consultation with the Human Resources Division. These policies and rules must in all cases confirm with the provisions of rules and of the applicable laws and must be approved by the General Manager Minor misconduct, if repeated over time, shall be treated as major/grave misconducts, and employees who commit any of these acts shall be liable for the following:- 1.1 1 st misconduct – 1 st written warning 1.2 2 nd misconduct – 2 nd written warning 1.3 3 rd misconduct – Final warning and 3 days suspension 1.4 4 th misconduct – Termination of service Inquiry The above list is not exhaustive.

1. The Hotel may, on the grounds of misconduct inconsistent with the fulfilment of the expressed or implied conditions of the employee's service, after due inquiry:-

(i)

Dismiss without notice the employee;

(ii)

Downgrade the employee; or

(iii) Impose any other lesser punishment as Management deems just and fit, and where a punishment of suspension without wages is imposed, it shall not exceed a period of two weeks. For the purposes of an inquiry under item (1), the Hotel may suspend the employee from work for a period not exceeding two (2) weeks and the wages will be payable for such period. 2.
