The employment application and interview are bound by the same constraints. Please refer to the list under the section, “Questions Not to Ask”. It is not always the question itself but the way the question is worded that can be a potential violation of the law. Some questions that are illegal to ask before hiring are legal to ask after the applicant has been hired. Insurance forms, for example, ask for date of birth, sex, marital status, dependents, etc. It is legal to collect this information after hiring because it can no longer be used to discriminate in the hiring decision. Be sure that employees do not misconstrue your offering. You should include “at- will” language in the application as a disclaimer.
