YOUR GUIDE TO PERSONAL INJURY IN THE BORDERLAND

JOINS HARMONSON LAW FIRM DYNAMO MEDICAL MALPRACTICE LAWYER HADLEY HUCHTON

I’m pleased to introduce the newest member of Harmonson Law Firm: El Paso native Hadley Huchton! Hadley, a mom and lawyer extraordinaire, officially joined the firm in 2018. She grew up right here on the west side of El Paso and is a proud graduate of El Paso High, aka “La High.” Hadley’s dad, Dr. Paul Huchton, is a longtime El Paso pediatrician. Perhaps you or your children were patients of Dr. Huchton. School, Class of 2020, and he’s a fantastic young man and student. Hadley stays busy helping Paul with the difficult task of applying to the best colleges and universities in the nation. My not-so-secret hope is that Paul will stay with us here in Texas after graduating from high school! Hadley is a fountain of knowledge on the college admissions process if anyone needs assistance with their teenage children. I definitely plan to rely on her knowledge as my older kids come of age. Hadley’s first passion is her family and her son, Paul. Paul will be a senior at Coronado High

epic legal battle, and she and I have kept in touch ever since. I have known her dad for a long time too; we go to the same church and are in the same Rotary Club. When he told me that Hadley was looking to venture out on her own, I jumped at the chance to have her work with us at Harmonson Law Firm. After graduating from Vanderbilt as an undergrad and the University of Texas School of Law, Hadley worked for many years defending doctors in medical malpractice cases. However, times have changed, and now her core focus is on suing doctors and hospitals who negligently harm patients. Hadley’s entire career has been focused on perfecting the art of medical malpractice lawsuits, and she is truly an excellent advocate for the injured. She knows the law, she knows the medicine involved in complex medical malpractice cases, and she knows that clients’ needs in these difficult cases always come first. The results of our medical malpractice efforts are really starting to take shape. Hadley has been instrumental in settling several significant medical malpractice cases against local hospitals and doctors in the last few months. Our clients have been able to get monetary settlements for their injuries and a sense of closure that otherwise would not been available to them if not for Hadley’s hard work and dedication. That’s what it is all about: getting justice for our clients. They come to us for help, and we are here to stand by their side. I look forward to working with Hadley for many years as we continue to pursue justice for victims of medical malpractice here in the Borderland.

I first met Hadley in a deposition when I was a new lawyer 15 years ago. At the time, the firm I was working for was suing a doctor for malpractice. Hadley worked for the firm that defended the doctor. Hadley’s doctor client won that “THAT’SWHAT IT IS ALL ABOUT: GETTING JUSTICE FOR OUR CLIENTS. THEY COME TO US FOR HELP, ANDWE ARE HERE TO STAND BY THEIR SIDE.”

Car Accident

This month, our five-part series comes to an end. It’s the fifth most common question we hear from clients. Following a car accident, there are always many questions that need to be addressed, especially when it comes to what to do next. But one we hear often comes down to time. THE TOP 5 QUESTIONS ANSWERED: QUESTION 5 The only true answer, unfortunately, is that it depends. It depends on the complexity of the case, the nature and severity of your injuries, and the willingness of the wrongdoer and their insurance company to accept responsibility and fairly pay for the damages and losses to you or your loved ones that they have caused. A quick settlement is almost always a bad settlement for the injured victim. With that said, we understand the financial difficulties a car accident can cause you and your family. That is why we aggressively and diligently work to get as prompt a settlement for you as possible. The first step we take together is to ensure that you or your loved one has the right medical treatment to address all the injuries caused by the accident. Once you or your loved one has reached maximum medical improvement, we communicate with our client and the insurance company to attempt a pre- lawsuit settlement of your claim. How long will my case take?

Ever since Netflix changed the way we consume movies and TV shows at home, studios have been locked in a streaming war. Amazon Prime and Hulu shook up the scene, along with more niche services like CBS All Access, DC Universe, and Crunchyroll. Is there room for one more? Disney seems to think so, and their new service is shaping up to be the king of streaming. What is Disney+? Disney has always prided itself on its family-friendly brand. This is the first major perk of their new streaming service, Disney+. There will be no R-rated films or TV-MA television shows anywhere on the platform. This is a great relief for parents who have had to deal with their kids accidentally navigating away from “Peppa Pig” videos on YouTube and finding adult content. Keep in mind that “family-friendly” doesn’t mean limited. Disney+ boasts a massive offering of original content, such as the live-action “Star Wars” series “The Mandalorian” and “Loki,” a show starring everyone’s favorite trickster god. There will also be live-action remakes of Disney animated classics alongside original movies, including a Christmas movie starring Anna Kendrick. New isn’t always better, which is why Disney+ will also house decades’ worth of classic content. Every single movie in the Disney catalog will be available on the service, from “Snow White and the Seven Dwarves” to “Frozen 2.” All “Star Wars” movies and Marvel movies will also become available along with over 5,000 episodes of old Disney Channel shows. Is Disney+ Worth It? That depends entirely on your family. If you don’t care for Disney, don’t waste your money. However, if you share a soft spot for classic Disney movies, enjoy new Marvel content, or secretly long to rewatch every episode of “Kim Possible,” Disney+ might be the streaming service you’ve been waiting for.

INSURANCE COMPANY TACTICS

If that fails, then a lawsuit is quickly filed and a court date is set to allow a jury to determine the fault of the parties and the proper amount of compensation for your injuries, harms, and losses.

While no case is typical, an average car accident case might reasonably look like this:

It’s no secret insurance companies exist to make money; they’re businesses, after all. Many of their commercials are designed to make you chuckle and remind you that they are on your side. However, the day you actually need to call an insurance company and make a claim is the day reality sets in. The goal of the insurance company is to pay you as little as possible so they can quickly close the case, even if they pay you nothing in the end. Here are some of the different tactics they use in order to do just that. Delays If you’ve been on the phone with an insurance company in the past because of a claim, you know it can be a lengthy process. You just want to get on with your day, and the insurance adjuster knows that. One phone call isn’t going to resolve your case. They may drag it out for weeks or months. In the middle of it all, they may tell you the amount they’re willing to pay. It’s almost always a low offer, but they know you need the money and you just want to get it over with. But if you take their offer, it comes with terms: The case is settled and you won’t get anything else, even if you need it. Requests When you’re on the phone with an adjuster, it’s common for them to make requests for just about every piece of information or documentation related (or even unrelated) to your claim. You may send that information to them, but when you call again, it still hasn’t arrived or is missing. They sometimes ask you for the same paperwork multiple times. It’s a runaround designed to get you to accept their initial lowball offer. 3 Strategies Adjusters Use to Pay You as Little as Possible

• 5–8 months for minor injuries, and the case is settled before a lawsuit has to be filed. • 6–12 months for more serious injuries, and the case is settled before a lawsuit is filed. • 1–2 years if a lawsuit is filed on your case because the insurance company contests liability or doesn’t want to adequately pay for the damages; this can also take longer if there is a catastrophic injury or loss of life involved and a lawsuit and/or trial is necessary.

PALEO TOMATO BASIL SALAD

INSPIRED BY NOM NOM PALEO

The main course on the Fourth of July almost always works with paleo diets, but that isn’t always the case with sides and appetizers. This salad offers a great way to enjoy some paleo fare without having to resort to only eating grilled meats.

INGREDIENTS

1 tbsp aged balsamic vinegar

1 small shallot, thinly sliced

1 tbsp extra-virgin olive oil

4–5 medium tomatoes, preferably heirloom, seeded and cut into wedges 6–10 medium basil leaves, cut into ribbons

Questions Adjusters bombard claimants with questions related to their medical condition after an accident. They are trying to come to one conclusion: that you don’t really need the medical care you claim to need. They don’t want to pay for the care you really need or have had. Most insurance adjusters are not medical professionals and do not have a health care background. That’s why it’s crucial to carefully track everything after an injury. The more documentation you have, the better.

Salt and pepper, to taste

DIRECTIONS

1. Place shallots in balsamic vinegar for 15 minutes. Drain and pat dry using paper towels. 2. Assemble tomatoes on a plate, top with basil and shallots, and season with salt and pepper. 3. Drizzle olive oil over top of salad and serve immediately.

Avoid the Summer Heat Somewhere Cool

CHILL OUT Relax in These Cool Destinations This Summer

As the scorching summer sun beats down, it’s hard to remember that just six months ago you were shivering through the winter, whether that meant a chilly 50 F or bitter subzero temperatures. But if cooler temps sound like paradise, and a dip in the pool is no longer keeping you cool, it might be time to take a vacation somewhere chilly. Check out these three destinations to avoid the summer heat. ALASKA No place says chilly quite like Alaska. Trips to Alaska can be expensive during this time of year, but when you step into that crisp air with a cool mountainous view, you’ll understand why it’s a popular summer voyage. Travelers can choose to fly or take a cruise ship, and many cities feature tourism-packed excursions. A few notable locations include Anchorage, the Kenai National Wildlife Refuge, and Denali National Park and Preserve.

summer heat. With temperatures rarely exceeding 60 F — the average high for the country — packing is easy for this relaxing vacation. Take a relaxing dip in one of the country’s many hot springs or enjoy tremendous views of the fjords. Even better, you can tour the country at any time because it’s sunny almost 24 hours a day. What could be better than a midnight hike around the fourth happiest country in the world? NORWAY Just because it’s summer doesn’t mean you have to give up your skiing hobby! Venture off to Norway and experience some of their most popular summer ski resorts. After a day or two shredding the slopes, experience the popular Norwegian Opera and Ballet in Oslo or choose between numerous outdoor and indoor exhibitions. Best of all, you won’t even break a sweat, as the average temperature in Norway’s hottest month barely hits 70 F. Bordering Sweden and northern Finland, Norway can even be the beginning to a cool European tour this summer.

ICELAND Just as its name suggests, Iceland can be the perfect destination for travelers yearning to get away from the unbearable
