When must a tribe notify the NIGC of its intent to issue a new or renewed gaming facility license?

u A tribe shall submit to the NIGC a notice or attestation letter that a facility license is under consideration for issuance by the TGRA, atleast 120 days before opening a new facility on Indian lands where Class II or Class III gaming is to occur;

u A Tribe MUST submit to the NIGC a copy of each newly issued or renewed facility license within 30 days of issuance; u this new or renewed facility license must be displayed in a public area of the gaming facility;

u the Chair of the NIGC may

respond to the tribe’s request, too, a tribe may request a written confirmation;

The notice or attestation letter from the Tribe to the NIGC shall contain the following:

u Name & Address of the property u A legal description/location of the property u The tract number for the property as assigned by the Bureau of Indian Affairs, Land Title and Records Office, if any; u A copy of the trust document or other deed to the property or an explanation of why such documentation does not exist;

u If not maintained by the BIA or Dept of Interior, documentation of the property’s ownership

u The NIGC will determine if the land parcel qualifies as Indian lands for purposes of IGRA and may request for additional information.
