u A tribe must submit to the NIGC 120 days prior to the issuance or opening of a new gaming facility, an attestation letter certifying that by issuing the gaming facility license, the tribe has determined that the construction and maintenance of the gaming facility and the operation of that gaming, is conducted in a manner which adequately protects the environment and the public health and safety; u This means that the tribe has adopted and complies with Regulation 559 Facility License Standards and has identified regulations and enforces laws, resolutions, codes, policies, standards or procedures applicable to each gaming facility that protect the environment and the public health and safety, including standards under a tribal-state compact or Secretarial procedures.

Facility license requirement – mini mart or gas station u A facility license is required for those locations where the extent of the gaming activity is a few machines in a mini mart or gas station. The Facility License Standards require a separate license for each gaming place, facility, location, premises where gaming activity occurs. If the place, facility or location is a stand-alone structure with no covered connection to another gaming place, facility or location then a separate facility license is required. u Even though full scale gaming is not occurring at these locations, it is important that the NIGC be made aware of each location of gaming and assurance (by facility license attestation) that the facility is constructed, operated and maintained in a manner that protects the environment, public health and safety of its patrons.
