Introduction
For 2018, the news headlines drove much of the agenda for the Regular Session of the Legislature. Hurricanes Harvey, Irma and Maria, sexual harassment scandals, and the Parkland shootings diverted much of the attention and focus of legislators. Of the nearly 3,200 legislative bills filed for the 2018 Session, only 166 general bills passed both legislative Chambers, and the Governor vetoed one of those. The 2018 legislative Regular Session led to wins and disappointments on issues important to Floridians ages 50+. This Voting Record sets forth summaries of those bills and how legislators voted on them. When the first legislative committee of reference placed on its public hearing agenda a bill significant to AARP’s members and Florida residents 50 years of age and older, AARP notified legislators by email (see p. 76 for an example) that AARP would track the bill and report the votes on that bill, or any successor bill, through the entire legislative process. AARP also provided updates on the legislative status of the bill to its volunteers and stakeholders via the AARP blog and AARP Twitter accounts. Section I of the 2018 Legislative Voting Record provides a complete list of all Florida legislators and their parties, districts, and county legislative delegations. Section II provides a summary of all the bills AARP Florida selected for the final voting record report. The summaries are set forth by subject matter areas (budget, health and supportive services, consumer protections, livable communities, and bills of interest that were not selected for vote recording). The summaries identify the pages where readers may review the voting records for each bill. Section III provides appendices that include sample communications to legislators and bills selected for vote recording by date of notice. This document is based on information as of March 23, 2018. HIGHLIGHTS
HB 5001 - General Appropriations Act 2018 and HB 5003 Implementing the 2018-2019 General Appropriations Act by House Appropriations Committee PASSED. The bills, respectively, are Chapters No. 2018-009-010 Laws of Florida, effective July 1, 2018. The Florida Legislature passed an $88.7 billion budget for fiscal year 2018-2019.
Impacts from the Appropriations Act Include:
Retroactive Medicaid Eligibility: The Agency for Health Care Administration (ACHA) will seek authorization from the Centers for Medicare and Medicaid Services (CMS) to eliminate the current three month retroactive eligibility period, which allows payments to providers for Medicaid services for up to 90 days before service recipients apply for Medicaid. Eligibility will continue to begin the first day of the month in which a non-pregnant adult (21 or older) applies for Medicaid. Statewide Medicaid Managed Care Long Term Care (SMMC LTC): SMMC LTC will receive a funding increase of $397,707,837. The program is designed to provide LTC services to Medicaid-eligible adults with disabilities and elders who need nursing home level of care. Those services include adult day health care, assisted living, caregiver training, hospice, medical equipment, respite care and various therapies. Nursing homes: Nursing homes will receive a $127 million increase in Medicaid payments to assist with continuous quality improvement. An additional $9.8 million will go to help nursing homes transition to the Prospective Payment System (PPS) in October, 2018. Under PPS, nursing homes will receive a pre-determined rate, inclusive of all services, provided to Medicaid LTC residents. Home and Community Based Long-Term-Care Services (HCBS LTC): HCBS LTC service programs will receive a combined increase of $2,050,000 and provide for 340 additional slots. HCBS services such as Alzheimer’s Respite Care, Community Care for the Elderly and Home Care for the Elderly provide opportunities for beneficiaries to receive services in their own homes or communities rather than in institutional facilities. Gains for HCBS are meaningful; however, there will continue to be long waitlists and growing unmet needs for HCBS LTC services.

Alzheimer’s disease Initiative (ADI): Alzheimer’s respite care services will receive an increase of $750,000 in general revenue funding to serve individuals on the statewide waitlist. Also, the Jewish Family and Community Services of Southwest Florida will recieve $75,000 in nonrecurring funds and the Alzheimer’s Community Care Association, Inc. will recieve $1,500,000 in nonrecurring funds. Community Care for the Elderly (CCE): CCE, a non-Medicaid program, will receive an increase of $500,000 in general revenue funding to serve elders on the statewide non-Medicaid waitlists. CCE provides HCBS services to seniors aged 60+ who are at risk for nursing home placement. CCE provides services such as day care, case management, home delivered meals and home nursing. Home Care for the Elderly (HCE): HCE will receive an increase of $800,000 in general revenue funding to serve elders on the statewide waitlist. HCE provides care in family type living arrangements for age 60+ non- Medicaid individuals. The Low-Income Pool (LIP): The Legislature continued funding for LIP at $1.5 billion. LIP funds help pay health care providers for uncompensated care. Although the federal government funds LIP through the state budget, local governments must provide a share of funds. Personal Needs Allowance (PNA): Nursing home residents receiving Medicaid long-term care services will see an increase in their monthly PNA, from $105 to $130. The PNA is for clothing, toiletries, personal hygiene products, vitamins or supplements, beauty or barber shop services, co-pays for prescriptions not otherwise covered by insurance, eyeglasses, hearing aids and batteries, etc.

Program for All-Inclusive Care for the Elderly (PACE): The budget provides an increase of $1,315,484 in funding to serve 100 additional individuals in Miami-Dade County; an increase of $1,129,663 in funding to serve 100 additional individuals in Lee County; an increase of $1,074,660 in funding to serve 100 additional individuals in Collier County; an increase of $1,173,367 in funding to serve 100 additional individuals in Baker, Clay, Duval, St. Johns, and Nassau Counties; and an increase of $880,025 in funding to serve 75 additional individuals in Martin County. PACE provides home-and-community–based–services for individuals who would otherwise qualify for Medicaid nursing home placement. Affordable Housing: The Legislature swept $198,370,000 million from a trust fund established exclusively for use with affordable housing programs. Funds are down $13,370,000 from last year, for a total of $123,630,000. The State Apartment Incentive Loan (SAIL) program will receive $79,180,000 to fund construction or rehabilitation of rental units for older adults, the homeless, and persons with developmental disabilities. The State Housing Initiatives Partnership (SHIP) program will receive $44,450,000 for emergency repair, new construction or rehabilitation of homes.

HIGHLIGHTS
Ratification of Agency for Health Care Administration Rules HB 7099, by the Health and Human Services Committee and Representative Magar, PASSED. The companion bill was SB 7030, by the Committee on Rules. The legislation is now Chapter No. 2018-123, Laws of Florida, effective upon becoming law. AARP supported this legislation. The legislation ratifies the Agency for Health Care Administration’s (AHCA) Rule 59A-4.1265, Florida Administrative Code, which requires licensed nursing homes, by July 1, 2018, to maintain an alternative power source, such as generators. That power source must be capable of cooling areas of not less than 30 net sq. ft. per resident at a temperature of 81 degrees or lower for at least 96 hours. Nursing homes also must have on-site 72 hours of fuel to power the alternative power source. The rule allows AHCA to grant compliance extensions until January 1, 2019, to NHs that demonstrate the need for extensions due to construction needs, delayed delivery of ordered equipment, zoning restrictions or other regulatory approval processes. The legislation is now Chapter No. 2018-122, Laws of Florida, effective upon becoming law. AARP supported this legislation. The legislation ratifies the Department of Elder Affairs Rule 58A-5.036, Florida Administrative Code, which requires licensed assisted living facilities (ALF), by June 1, 2018, to maintain an alternative power source, such as a generator, that can air-condition an area of no less than 20 net sq. ft. per resident at a temperature of 81 degrees or lower for at least 96 hours. AARP supported this legislation. Insurance plans may require an insured to try particular drug(s) or treatment(s) before the plans will cover alternative drugs or treatments. The legislation would have required health insurers to establish expedited, standardized processes for medical practitioners to use when seeking authorizations for patients to initially use the alternative drug or treatments. Emergency Power for Nursing Home and Assisted Living Facilities CS/SB 1874, by Senator Passidomo, FAILED. AARP supported this legislation. The legislation would have required, by June 1, 2018, that nursing homes and assisted living facilities (ALF) have an operational emergency power source and fuel sufficient to sustain an air temperature of 81 degrees for at least 96 hours. It would have also required nursing homes and ALFs to have plans for monitoring residents to ensure they would not suffer complications from heat exposure. The legislation would have directed nursing homes and ALFs unable to sustain these safe temperatures to plan for safely transporting residents to compliant facilities. See Voting Record for CS/SB 1874 p.31 Services for Veterans and Their Families HB 179, by Representative Burgess, FAILED. The companion bill was CS/SB 326, by Senator Young. AARP supported this legislation. The legislation would have established the Florida “Veterans’ Care Coordination Program” within the Department of Children and Families. The program would have provided for statewide behavioral health, substance abuse and mental health referral services for veterans and their families through Florida’s “211” telecommunication Networks. See Voting Record for HB 179 p. 32; CS/SB 326 p. 32. Payment of Health Care Claims SB 162, by Senator Steube, FAILED. The companion bill was CS/HB 217, by Representative Hager. AARP supported this legislation. The legislation would have prohibited health insurers and health maintenance organizations (HMOs) from retroactively denying claims if they verified, at any time, the eligibility of the insureds or subscribers and issued authorization numbers to providers. The legislation would have exempted Medicaid managed care plans from the provisions of the bill. See Voting Record for SB 162 p. 33; CS/HB 217 p. 34. Performance of Physician Assistants and Advanced Registered Nurse Practitioners HB 973, by Representatives Daniels and Plasencia, FAILED. The companion bill SB 708, by Senator Brandes, never had a committee hearing. AARP supported this legislation. The legislation would have permitted physicians to delegate authority to Advanced Registered Nurse Practitioners (ARNP) and Physicians’ Assistants (PA) to sign, certify, stamp, or endorse any documents Florida law authorizes physicians to do. However, PAs or ARNPs, who are not psychiatric nurses, would have been prohibited from approving the release of individuals from mental health receiving facilities. See Voting Record for HB 973 p. 34. Telehealth CS/SB 280, by Senator Bean, FAILED. The companion bill HB 793, by Representative Massullo, never had a committee hearing. AARP supported the legislation. The legislation would have established practice standards for telehealth services. Telehealth practitioners may diagnose and treat patients who are in locations different from the practitioners. See Voting Record for CS/SB 280 p. 36.

Nursing Home and Assisted Living Facility Resident Rights CS/CS/HB 443, by Representative Slosberg, FAILED. The companion bill SB 830, by Senator Farmer, never had a committee hearing. AARP supported this legislation. The legislation would have aligned Florida law with federal regulations. It would have required nursing homes to provide residents access to, but not copies of, personal and medical records within 24 hours of the residents’ requests (excluding weekends and holidays) and to provide copies of the records to residents or their authorized representatives within two working days of the requests. It would have required ALFs to give residents (or their legal representative) 45 days advance written notice before relocating residents or before terminating their residencies. ALFs would have had to provide the reasons for those decisions. See Voting Record for CS/CS/HB 443 p. 37. Florida Veterans Care Program SB 440, by Senator Garcia, FAILED. The companion bill HB 403, by Representative Avila, never had a committee hearing. AARP supported this legislation. The legislation would have created the “Florida Veterans Care” program in the Agency for Health Care Administration. The program would have provided Florida veterans and their families alternative health care delivery systems, similar to or within those of the Medicaid managed care program. See Voting Record for SB 440 p.38. Health Care Disaster Preparedness and Response CS/HB 7085, by the Health and Human Services Committee and Representative Massullo, FAILED. AARP supported this legislation. The legislation would have required nursing homes, assisted living facilities, home health agencies and other entities to address inadequacies in emergency plans. It would have subjected these facilities/programs to unannounced inspections. It would have directed the Department of Health (DOH) to recruit health care faculty, students and state employees (who are health care practitioners) to staff local special needs shelters.
