2. Approval. The Zoning Administrator may approve the requested administrative adjustment if, in comparison to strict compliance with the zoning requirements, the adjustment would: a. Be compatible with existing and permitted uses on surrounding properties, causing no significant adverse impact on existing uses, properties or improvements. b. Have no significant adverse impact on pedestrian or vehicular traffic safety, including traffic that the adjustment itself might reasonably be expected to generate. c. Not be detrimental to the public health, safety or welfare. 3. Administrative Adjustments Allowed. The Zoning Administrator may make administrative adjustments only as follows: a. Minimum lot size, width, depth and setback requirements may be reduced by up to 10% . b. Maximum lot coverage and height requirements may be increased by up to 10% . c. Parking and loading area requirements may be reduced by up to 10% . 4. Conditions. The Zoning Administrator may require conditions for approval of an administrative adjustment, including but not limited to: a. Time limits.
5. Notice. The Zoning Administrator must provide prompt written notice to the Applicant of their decision on the administrative adjustment, including any conditions attached to approval. a. The Zoning Administrator must provide the Planning Commission with copies of these notices at the Commission's next regularly scheduled meeting. 5. Appeal. An aggrieved party may appeal the Zoning Administrator's determination of an administrative adjustment to the Board of Zoning Appeals. (See Zoning Regulations, Section 11-108, Appeals.) 101 Zoning Permits A. Issuance. 1. Any zoning permit issued in conflict with the provisions of these Zoning Regulations is null and void. 2. A zoning permit must be obtained from the Zoning Administrator, before beginning any construction, reconstruction, moving or structural alteration of any building or structure, or improvement of land prior to its use. a. Zoning permits must not be issued by any other official, employee, department, board or agency of the City. 3. A zoning permit must be either issued or disapproved by the Zoning Administrator within 10 days after the receipt of an application , or within a period agreed on by the Applicant and the City. a. The Zoning Administrator must advise the Applicant in writing of the reasons a zoning permit is disapproved.
b. Access, screening, landscaping, drainage, or other requirements necessary to prevent damage to adjacent properties or safeguard public interests.
