101 Condominiums. A. The Kansas Apartment Ownership Act cited in K.S.A. 58-3101 et seq. governs the ownership, management, taxation, contents of the declaration of condominium ownership, and other matters related to the sale and operation of condominiums and their independent units. (See definition of CONDOMINIUM.) 1. Independent condominium units may be used for residential, office, business, industrial and other uses as permitted by respective zoning districts. 2. Provision for City Maintenance. The contents of the declaration of condominium ownership as required by K.S.A. 58-3111 must also include a provision allowing the City to maintain any part of the condominium's commonly held property, if necessary to avoid having it become a public nuisance. (See definition of PUBLIC NUISANCE.) a. The Zoning Administrator must be satisfied that such a provision is included in the declaration before a zoning permit or occupancy certificate will be approved . b. If the City is required to assume responsibility for any condominium maintenance, the maintenance costs will be assessed against the unit owners as a tax lien on the condominium units.
102 Electric Vehicle Charging Stations A. Level 1 (slow charging) or Level 2 (medium charging) electric vehicle charging stations are permitted as an accessory use to any principal use, in any zoning district. B. Level 3 or greater (rapid charging) electric vehicle charging stations. 1. Private. In any zoning district, a Level 3 or greater charging station which does not provide services to the public may be allowed as a conditional use when accessory to a principal use. 2. Public. In business or industrial zoning districts only, a Level 3 or greater charging station which provides services to the public may be a permitted or accessory use . C. Battery exchange stations are prohibited in all residential zoning districts, but may be allowed as a special use in business or industrial districts.
