4. RESIDENTIAL-DESIGN MANUFACTURED HOME. Built on or after June 15, 1976. a. Body must be at least 22 feet wide. b. Must have a pitched roof, and be constructed with siding and roofing materials which are customarily used on site-built homes. c. Must be installed on a permanent foundation. B. Federal Regulations. 1. Mobile homes built prior to June 15, 1976 are not subject to the U.S. Department of Housing and Urban Development's Manufactured Housing Construction and Safety Standards Act . 2. Manufactured homes and residential-design manufactured homes , built on or after June 15, 1976, are subject to the U.S. Department of Housing and Urban Development's Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. 5401-5426). (Regulations are in the Electronic Code of Federal Regulations (e-CFR) parts 3280, 3282, 3284, 3285, 3286, 3288, and 3800.) a. Every section of a manufactured or residential-design manufactured home must bear a label certifying that it is built in compliance with the Act. C. Zoning. 1. A manufactured house must be limited to use as a single dwelling unit . 2. Nonconforming occupancy or use. Manufactured houses which exist on the date these Zoning Regulations are approved may continue any existing occupancy or use which was legal at that time, provided that the continued use is not dangerous to life, health or safety. a. If such an existing occupancy or use is changed , the manufactured housing must subsequently comply with all applicable provisions of these Zoning Regulation.
105 Manufactured Housing A. Definitions. Manufactured housing includes mobile homes, manufactured homes, and residential-design manufactured homes. 1. All three types of manufactured housing are fabricated in a factory setting as dwelling units, are built on a permanent chassis, are transportable in one or more sections, and include plumbing, electrical, heating, and air conditioning systems. a. The following are not considered to be manufactured housing: (1) RECREATIONAL VEHICLES. (2) Job trailers or construction trailers. (3) Portable classrooms or portable offices. b. For the purposes of these Zoning Regulations, a manufactured housing unit is considered to be a DWELLING UNIT, but is specifically excluded from the definition of DWELLING. 2. MOBILE HOME: Built prior to June 15, 1976. a. In traveling mode, body must be at least 8 feet wide and 36 feet long. b. May or may not be installed on a permanent foundation. 3. MANUFACTURED HOME. Built on or after June 15, 1976. a. In traveling mode, body must be at least 8 feet wide and 40 feet long. b. When erected on site, body must be at least 320 square feet in area. c. May or may not be installed on a permanent foundation.
