Numerous provisions take place before and during shipment, conducted either by the FRA or by FRA-certified state inspectors. Licensee: 10 CFR 73.37(c)6) DOE uses TRANSCOM 10 CFR 73.37(b)(3) (see below) 49 CFR 397.103 gives states the authority to designated preferred highway routes for HRCQ shipments (see below). See “important distinctions” above DOE focuses its TEPP training on states/Tribes affected by DOE shipments, not licensee shipments. Training may be available along routes to be used by licensees, but only if DOE has sufficient funding available. The desire for training would need to be reported to DOE well in advance. It is not clear whether DOE would fund the SRGs to assist states with their responsibilities in connection with licensee shipments.

10 CFR 73.37(b)(1)(iv) requires preplanning and coordination to take place no later than two weeks before the SNF shipment. Preplanning and coordination involves the governor’s designee of each state through which or across whose boundaries the shipment will pass. The objectives of this activity are to: A. Minimize intermediate stops and delays; B. Arrange for State law enforcement escorts; C. Arrange for positional information sharing when requested; and D. Develop route information, including the identification of safe havens. 10 CFR 73.37(b)(1)(v) requires the licensee to “arrange with local law enforcement authorities along the shipment route, including U.S. ports where vessels carrying spent nuclear fuel shipments are docked, for their response to a security- related emergency or a call for assistance .” 10 CFR 73.37(b)(3) Transportation physical protection program . (i) The transportation physical protection program established under paragraph (a)(1) of this section shall include armed escorts to protect spent nuclear fuel shipments and a movement control center, as defined in § 73.2 of this part, staffed and equipped to monitor and control spent nuclear fuel shipments, to communicate with local law enforcement authorities, and to respond to safeguards contingencies.
