4.11 Substance Abuse Policy MOLLY MAID believes that the impairment of any employee due to use of substances is likely to result in the risk of injury to other employees, the impaired employee, or to third parties, such as customers, or damage to property. Our position regarding use of alcohol, marijuana, illegal drugs, prescription drugs, or controlled substances (“substances”) is uniform. “Impairment” means that an employee’s normal physical or mental abilities, or faculties, while at work have been adversely or detrimentally affected by the use of any substance. If you begin work while impaired or become impaired while at work, you are guilty of a major violation of MOLLY MAID policy and are subject to severe disciplinary action that can include suspension, immediate dismissal, or any other penalty appropriate under the circumstances. Likewise, we prohibit the use, possession, transfer, or sale of any controlled substance or illegal drug on company or customer premises or while on duty or in any MOLLY MAID vehicle, parking lot, storage area, or job site. Violations are subject to severe disciplinary action. If you are taking prescription drugs, you are under a duty to report this to your supervisor. This is for your protection and for safety purposes in case of an adverse reaction to the drug while at work, or so you not falsely accused of taking an illegal substance. If an employee is involved in the use, possession, transfer, or sale of a substance in violation of this policy, MOLLY MAID may notify appropriate authorities. We will give such notice only after the incident has been investigated and reviewed by the franchise owner. If you suspect a substance abuse case, discuss the situation immediately with the franchise owner. Because each case is different, the franchise owner must handle each situation independently. We will consider applicants who have a past history of substance abuse and who have demonstrated an ability to abstain from the substance, or who can provide medical assurance of acceptable control, for employment with MOLLY MAID as long as they are otherwise qualified for the position for which they are applying. Management has chosen to adopt an alcoholic beverage policy in keeping with the concern for the risks partnered with alcohol use. We will not serve or use alcoholic beverages on MOLLY MAID or customer premises at any time, while on duty, or while in or operating a MOLLY MAID vehicle. Alcoholic beverages have no part, and shall not be used, in conjunction with any MOLLY MAID business meeting.
