Ombudsman closes file on Russell council case

GREGG CHAMBERLAIN gregg.chamberlain@eap.on.ca

Ontario’s Ombudsman has closed the file on a complaint that Russell Township council violated the guidelines for holding a closed session. A copy of the complete report is included in the agenda package for council’s Nov. 2 regular session and is available to view online through the municipal website at www.russell.ca. The report, comments and recommen- dations from Barbara Finlay, the acting Ombudsman, concerns a complaint filed about a closed session of council on June 1 this year. The complaint alleged that closed session was illegal because council dealt withmatters that did not fall under the gui- delines for in-camera sessions. The Ombudsman report noted that du- ring the closed session that followed the regular open portion of council, mayor and councillors heard and watched a presenta- tion on the rebranding exercise for Russell Township, including viewing a proposed new logo and slogan for the municipality. Prior to the start of the presentation, noted the Ombudsman’s report, Mayor Pierre Le- roux had told councillors they could take

tion and training” guideline to the rebran- ding presentation to place it within a closed session, because the information presented then was used for the basis of a decision during the open meeting that

item that was discussed. The Ombudsman found the complaint valid and noted that council and adminis- tration need tomake sure that the public has enough details about a proposed in-camera item for discussion to meet the guidelines for a closed meeting. The Ombudsman report also praised Russell Township council for its efforts at transparency through public recordings and webcast broadcast for open sessions of council. The report noted that the video recording stops when council goes into a closed session and does not restart when members come out and an open meeting resumes. The report recommended all of a council session, both open and closed, be video recorded to meet the guidelines for trans- parency and also to assist with any possible future complaints that the Ombudsman’s office may need to investigate. The report also stated that the open ses- sion of council, both before and after a closed session, should be always available to the public by webcast. Dog Control review committee Russell Township dog owners ordered to muzzle their pets will soon have an appeal process to plead for clemency. Council appro- ved a recommendation from administration for creation of a Canine Control Review Com- mittee as allowed for under the Ontario Municipal Act for municipal animal control needs. The committee will hear appeals from dog owners who have been ordered to keep their pets muzzled when outside because of concerns for public safety. Right now, there is one case pending of a resident who in July this year was ordered to muzzle his dog. The dog owner has asked to appeal the order but time is needed to set up the committee. To help the dog owner gain a quick resolution to his pet’s plight, council itself has agreed to hear the matter during a special session later in November. – Gregg Chamberlain
