7. BIDDING PROCEDURES: All donkeys sell to the highest bidder. Any disputes or challenges regarding bids will be resolved by the auctioneer, and such decisions are final.
a. The Seller reserves the right to: Declare a “No Sale” or set a reserve price after the final bid. b. By placing the winning bid, the Buyer enters into a binding agreement to purchase the animal.
8. ANNOUNCEMENTS: Announcements made from the auction block on the day of the sale shall take precedence over any information contained in the sale catalog, promotional materials, or online listings. The Sale Management assumes no liability for errors, omissions, or inaccuracies appearing in catalog or web-based sources from web or catalog sources. 9. RISK & LIABILITIES : The Seller retains all risk and responsibility for their donkey until the auctioneer declares the animal sold. Upon the auctioneer’s declaration of sale, the Buyer assumes full risk, responsibility, and expense for the donkey, including but not limited to injury, illness, loss, or death.
Breeders Classic Midwest Miniature Donkey Sale Management and staff, the auctioneer and staff, sponsors, facility owners, and Sellers shall not be held liable for accidents, injuries, personal property loss (including animals), or property damage occurring before, during, or after the sale.
Pursuant to applicable Wisconsin statutes governing equine activities, all persons attending this event do so at their own risk.
10. NO IMPLIED WARRENTIES: No warranties, express or implied, are made by the Breeders Classic Midwest Miniature Donkey Sale Management, staff, auctioneer and staff, sponsors, facility owners, or Sellers regarding the soundness, merchantability, or fitness for any particular purpose of any donkey offered for sale. All donkeys are sold “as is” with all existing conditions and defects. The Seller is solely responsible for the accuracy of the donkey’s representation. Any disputes arising from such representations shall be strictly between the Buyer and Seller.
