Due Process of Law in Administrative Hearings
§ A fundamental, constitutional guarantee that all legal proceedings will be fair. § That parties will be provided notice of the proceedings. § That the notice will provide the basis for the proceedings. § That parties will be provided an opportunity to defend themselves against any allegations of wrong doing. § That law shall not be unreasonable, arbitrary, or capricious. § Ensures that actions or decisions are based on reason and not on personal will or discretion without regard to rules or standards. § It is important that decisions are made based on facts, circumstances, and evidence presented at the hearing.
