Preparation

§ Based upon the type of action, anticipate what equipment and space will be needed in advance of the hearing and ensure that you have an adequate environment available to hold the proceedings. § Ensure that you have a designated spaces for Respondents and TGRA staff, for Hearing Officers to overlook the proceedings, and for individuals to present testimony. § If you are recording the proceedings, make sure that microphones and video equipment is set up in advance and is operational. § If you have a Court Reporter, ensure they are placed where they can hear the Hearing Officer and witnesses clearly so that they can take the appropriate notes. § If you are using video evidence, ensure that you have monitors that everyone can see and someone available to operate the playback functions. § It may be necessary to have a bailiff and/or security present for safety.

Public Record

§ Public hearings should be held whenever possible, the transparency of the actions of the TGRA is crucial to demonstrate that the process is fair and that decisions are not arbitrary and capricious. § An open process can protect you in the event your determinations and/or actions are unfavorable with leadership. § Proprietary information should always be kept private and confidential. § Proprietary documentation can still be used in a public hearing so long as it is marked appropriately and any testimony is provided in a closed hearing or summarized for the record. § In such instances where the information or circumstances surrounding an administrative action can be harmful to the tribe, or upon reasonable request, a hearing should be closed to the public and confidential.
