Determinations of the Hearing Officer
Settlements
§ Often times when faced with a Notice outlining violations, a respondent subject to the administrative action will seek alternatives to having a hearing or risking the potential sanctions that could be ordered. § Settlements could consist of a request to withdraw a gaming license application in lieu of a denial of licensure. § Such settlements could include that the applicant not apply for a license in the future or until the issues that prevent licensure are corrected. § Conditional licenses could be agreed to prior to the hearing which could outline circumstances or measures that a Licensee will meet as part of the conditions for maintaining a license. § Perhaps the Gaming Enterprise is agreeable to providing a patron with measures to satisfy a dispute.
