Orders
§ Orders should be consistent with the authority and jurisdiction of the TGRA as provided in the Gaming Ordinance and Regulations. § Orders and Judgments may include: § Dismissal of an action or part of an action; § Default judgments in the event that a respondent or subject does not appear; § Order denying licensure; § Order conditioning, limiting, or suspending a license; § Order compelling a respondent or subject to take a particular action; § Order to cease and desist a respondent or subject from performing a particular action(s); § Order compelling the Gaming Enterprise to create or enact SICS or other internal controls; § Order limiting or conditioning a vendor contract or gaming devices; § Order compelling vendors to perform corrective actions; § Order compelling the Gaming Enterprise to satisfy requested compensation of a dispute; and § Orders of admonishment, censure, or reprimand.
Fines
§ An order or judgment of the TRGRA could include a civil fine for each violation. § A civil fine could include a continuing fine for each day such violation occurred. § Civil fines should be limited to the TGRA authority and within the specified range approved under the Gaming Ordinance or Regulations. § Civil fines may be suspended pending the outcome of corrective action on the part of the respondent or subject. § Fines should be proportionate to the action, taking into consideration the salary range or financial obligations of the respondent or subject. § Civil fines should not be used as a method of sustaining the TGRA budget, they should be issued based on the merits of the action.
