Dear Fulton County Commissioners and Citizens,
As we continue our pursuit of excellence in public service, I am pleased to present the 2024 Annual Report from the Office of the Clerk to the Commission. This report highlights the progress and achievements we have made throughout the year, all driven by our unwavering commitment to supporting the Fulton County Board of Commissioners and other departments and agencies across Fulton County Government. In 2024, our team remained focused on delivering exceptional administrative support and enhancing the quality of service for our internal and external stakeholders. Through our efforts, we’ve advanced transparency, accessibility, and efficiency: core values that guide our work every day. A central responsibility of our office is the stewardship of official County records, codes, and minutes, as required by both State Law and the Fulton County Code of Ordinances. We take this obligation seriously, ensuring accuracy, accessibility, and compliance with all applicable policies and regulations.
In full compliance with the Open Meetings Act, our team continues to provide critical support for all Board of Commissioners’ meetings. This includes preparing and distributing Public Notices, Agendas, Post Agendas, and Minutes, each step reinforcing our commitment to transparency and the principles of good governance.
As custodians of records management, we recognize that excellence is a continuous journey.

THE CLERK TO THE COMMISSION
is the official keeper of the County seal and records; and oversees extensive administrative and legislative operations on behalf of the Board of Commissioners. This is managed through the preparation and sounding of the agenda, researching legislative records, and maintaining an accurate account of all actions and records of the Board. The Clerk to the Commission
works with various county departments and officials to conform contracts, prepare ordinances, resolutions and amendments for codification, and manage administrative and legislative functions. The Office of the Clerk to the Commission
Fulton County Code of Laws, Article II, Division 2 Sec. 101-61. - Meeting times and places.
Meetings are held at 10:00 a.m. on the first and third Wednesday of each month unless special circumstances dictate a different meeting date, time, or place. In the event that special circumstances dictate a different meeting date, time, or place, the public shall be duly notified in accordance with O.C.G.A. tit. 50, ch. 14 (O.C.G.A. § 50-14-1 et seq.), the Georgia Open Meetings Law. (93-RC-701, Rule 1, 1-19-94)
All meetings of the Fulton County Board of Commissioners shall be held in the Assembly Hall of the Fulton County Government Center, 141 Pryor Street, S.W., Atlanta, Georgia 30303. In accordance with state law, the first meeting of the month shall be held without exception. In the event that there is no quorum present at the scheduled starting time for that meeting, the chair shall wait 30 minutes to see whether a quorum will be present. If a quorum is not obtained after this waiting period, the chair shall adjourn the meeting and re-advertise it in accordance with state law.

It shall be the duty of the clerk, after the adjournment of the meeting or after a recess in any session thereof, if such meeting is not adjourned, to prepare in written form, the minutes of such meeting, using as his sources therefor, any notes, memoranda, or other materials which may be available as an aid to his memory, of all transactions which occurred at such meeting and the action of the county commission thereon, which written record shall be prepared and reduced to writing by the clerk independently under his own oath of office... ( Code 1983, § 22-3-2) O.C.G.A. Sec. 102-113. - Preparation of minutes. (e) (1) Prior to any meeting, the agency or committee holding such meeting shall make available an agenda of all matters expected to come before the agency or committee at such meeting. The agenda shall be available upon request and shall be posted at the meeting site... O.C.G.A. 50-14-1 It shall be the duty of the clerk of the county commission, or in his absence, the deputy clerk, to attend all meetings of the county commission and to keep faithful and accurate records of all such meetings. (Code 1983, § 22-3-1) FULTON COUNTY CODE OF LAWS Sec. 102-112. - Procedure for keeping minutes; attendance at commission meetings. LAWS
(a) The Fulton County Board of Commissioners holds a regular meeting (first Wednesday of the month) and a recess meeting (third Wednesday of the month). The agenda is prepared by the clerk's office in concert with the county manager's office. The deadline for submitting items for regularly scheduled board of commissioners' meetings to the clerk's office for inclusion on the next agenda is 10:00 a.m. on Friday prior to the meeting. A final copy of the agenda is distributed to the commissioners, county attorney, county manager and appropriate staff by 2:00 p.m. on the Friday preceding the scheduled meeting of the board. Copies are also made available to the public at that time. Sec. 101-66. - Agenda, preparation of; public comment.

Develop Agendas in coordination with the Board of Commissioners, County Manager, and Zoning Division. Sound Agenda items for the Board of Commissioners.
Publish Post Agendas and Verbatim Minutes in accordance with deadlines of forty-eight hours and thirty days, respectively.
Provide Agendas and speaker cards, as requested.
Create and maintain an official audio recording of Board of Commissioners’ meetings.
Provide meeting and voting statistics
Update and implement procedural rules in concert with Board of Commissioners and County Attorney.
Prepare and mail letters to Zoning applicants regarding Board of Commissioners' actions.
Serve as time keeper, and record motions and directives. Manage annual contract with court reporter to assist with the development of Verbatim Minutes.
Assist citizens with inquiries during the Board of Commissioners’ meetings.

Open Meeting Act, O.C.G.A. § 50-14-1 et seq.
(2)(A) A summary of the subjects acted on and those members present at a meeting of any agency shall be written and made available to the public for inspection within two business days of the adjournment of a meeting. ( 2)(B) The regular minutes of a meeting subject to this chapter shall he promptly recorded and such records shall be open to public inspection once approved as official by the agency or its committee...
(e)(1) Prior to any meeting, the agency or committee holding such meeting shall make available an agenda of all matters expected to come before the agency or committee at such meeting. The agenda shall be available upon request and shall be posted at the meeting site as far in advance of the meeting as reasonably possible, but shall not be required to be available more than two weeks prior to the meeting and shall be posted, at a minimum, at some time during the two-week period immediately prior to the meeting... ROLES & RESPONSIBILITIES
Indigent Burials
Financial Disclosures In accordance with the Fulton County Code of Ethics, certain Fulton County officials (as defined) are required to submit to the Clerk’s Office a Personal Financial Disclosure Statement, which reports all sources of income from the preceding calendar year. The Clerk’s Office creates the document in coordination with the County Attorney. The Clerk receives the statements, files them accordingly, and makes them available upon request. Those required to file include the Board of Commissioners, Sheriff, District Attorney, Tax Commissioner, Solicitor General, Clerk of Superior Court, various department heads and property appraisers.
The County, accordance with Georgia Law (36-12-5), provides funds for the burial of deceased citizens whose families cannot afford funeral costs. The County pays $600 for funeral services and pays a separate contracted amount for cemetary services. The Department of Family and Children Services (DFACS) manages the County’s Burial Program. The Clerk’s Office reviews the documentation from DFACS, approves payment to the funeral home, and keeps a record of the transaction.

Certificates of Need A certificate of Need is a request by a health care organization for financial assistance from the State Health Planning Director to develop or expand health care services and facilities. The State requires that the application for a Certificate of Need be filed in the Clerk’s Office, which prepares a receipt for the applicant, sends a copy of the receipt to the State, and keeps a record of the documents.

ROLES & RESPONSIBILITIES
Technology The office of the Clerk to the Commission is the first line of defense for correcting the IT technical and maintenance problems for the systems utilized by the Fulton County Board of Commissioners and their staff. These issues can range from minor application glitches to complete system re-installations.
Customer Service The Clerk’s Office manages the reception area for the Board of Commissioners and the County Manager’s Office and places considerable emphasis on exceptional customer service.

BOARDS APPOINTMENT MANAGEMENT
The County has numerous Boards, Authorities, and Commissions that provide a variety of services for Fulton County Government. Members of the Board of Commissioners either serve or appoint citizens to serve on these organizations. Some of these citizens must be sworn in to their positions. The Clerk to the Commission administers an oath of office to these individuals, as requested.
Board Appointment Management responsibilities include: Maintain the County Board Management System (CBMS). Update contact information of appointees; receive and file resumes. Maintain information for points of contact and operating procedures for each Board, Authority, Commission and Task Force. Maintain historical legislation and general information about each Board. Notify Board of Commissioners of vacancies, term expirations, and resignations of the various Boards. Prepare and mail correspondence to announce when the Board takes action on the appointments. Process stipend payments to the members of the Board of Ethics.

RECORDS MANAGEMENT
Sec. 102-116. - Certification of minutes.
The Clerk is hereby prohibited from certifying any minutes of the county commission or excerpts therefrom until and unless the minutes from which such excerpt is taken have been ratified and approved by the county commission; provided, however, the clerk may furnish a copy or excerpt of a preliminary draft of the proposed minutes of the county commission without a certification; provided, however, where such excerpts are prepared and furnished by the clerk, there shall be noted thereon that the same are not official minutes but are tentative and as such are not binding on the county or any officer thereof. (Code 1983, § 22-3-5)

O.C.G.A. 50-18-70. Legislative intent; definitions.
(b) All public records of an agency as defined in subsection (a) of this Code section, except those which by order of a court of this state or by law are prohibited or specifically exempted from being open to inspection by the general public, shall be open for a personal inspection by any citizen of this state at a reasonable time and place; and those in charge of such records shall not refuse this privilege to any citizen.
(2) “Public record” means all documents, papers, letters, maps, books, tapes, photographs, computer based or generated information, data, data fields, or similar material prepared and maintained or received by an agency or by a private person or entity in the performance of a service or function for or on behalf of an agency or when such documents have been transferred to a private person or entity by an agency for storage or future governmental use.
