I recommend using different forms of marketing until one form of marketing begins to provide more significant results than any of the others and stick with it. Statistics have shown it may take up to seven touches before a business or consumer interacts with you or your business, thus the reason to be consistent. Remember, a company out of sight will eventually be out of mind. Each month the Sales and Marketing Council discusses issues critical to your business. This month Sales & Marketing welcomed 5 industry experts. The discussion focused on how Metro businesses can generate “Awareness”. There was Q&A about social media opportunities, direct mail & many other options. Please join us for our next breakfast meeting on April 19 where the topic will be “The 3 Stages of Preparation Required for Success”.

I find myself in disbelief that we are almost a quarter of the way through the year and my term as President. I can only hope that the remainder of the year is as productive and fruitful as it’s been already. My time at IBS was well spent learning some new tricks of the trade and attending the Leadership Council events. While those were impactful, they were second to witnessing the brotherhood/sisterhood of our community. I left there knowing we are all in this together and I’m more invested than ever in our causes and proud of our accomplishments. I shook the hands of our leadership, watched the new guard get installed (still feel like my speech was better), and felt truly seen and heard. How does that translate to us as a chapter in NJ? The 2023 board’s initiatives were, unbeknownst to us, completely in line with what was being discussed on the national level. We declared that this year, only due to the unbelievable footwork laid out by my predecessors, was to be about collaboration. With that being said we have some new and exciting events coming up that we hope will bring you valuable information and the opportunity to rub elbows with members from our other chapters. We’ve also had success with finding ways to get in front of the future generations to spread the word about the unbelievable opportunities in the trades and their affiliations. To date, we have four career fairs on the books and counting. I hope to keep bringing information like this to you month after month. I’d be remiss if I took credit for any of it, as this is the work of many brains, hours, and efforts from our board and members. I am excited to see what the next month brings!

Our goal at Metro is to bring our members together to not only network, but to find value in the services each of you provide. #membersdoingbusinesswithmembers From April through June, Metro will be participating in the NAHB Spring Membership drive. If our membership increases between 3 – 5.99% in this period, all members who recruited ‘New’ members during this time will receive 2 x Spike credits. If we increase our membership by 6% or more, all members who recruited ‘New’ members during this time frame will receive 3 x Spike credits. This is a great incentive for our members to accrue Spikes. So, What are Spike Credits? When you recruit and retain members, you are not only giving back to the industry, you will also be recognized and rewarded through NAHB’s Spike Club. As you continue to recruit and retain additional, you accrue more Spike credits and achieve different levels of recognition for your Spike Status. To become a Spike, you must earn at least 6 credits. The best way to earn credits is to recruit a new member. And what better time to recruit new members than during our membership drive, where you can potentially early Double or Triple credits. This always makes me think that as a business owner we are so committed to our own businesses that we don’t know what is going on at policy levels and where the industry is heading towards. By being part of the metro builder community I never felt standing alone. APRIL CELEBRATES NATIONAL REBUILDING DAY - APRIL 29, 2023 By Linda Garvey, Metro’s PWB Council Chair; Coppola Brothers LLC April is “National Rebuilding They are a non-profit organization in the US dedicated to sustaining affordable homeownership and regenerating neighborhoods by providing free house repairs and improvements to neighbors in need. This event was started by a small group of citizens in Midland, Texas who recognized a rising need in their community in 1973 where homes in their neighborhood had fallen into disrepair, and their neighbors couldn’t afford to renovate them themselves. The group gave their time and skills to help their neighbors rehabilitate their homes. Recognizing the potential impact of their effort, the group founded “Christmas in April” with the intention of undertaking repair and rehabilitation work in their neighborhood each April. The group’s positive work spread slowly at first, but it eventually gained national prominence. The mission expanded from delivering service once a year in April to bringing together partners from all walks of life to aid the neighbors every year. In 1988, they established a national headquarters and changed their name to “Rebuilding Together”. Why celebrate this day? It brings local communities, contractors and sub-contractors together by assisting with the rehabilitation of individuals in need’s homes. Majority of homes in the US were built before 1980 and require regular repair. The issue is that most low-income homeowners cannot afford to perform home repairs. This organization is here to help. Despite its origins in Chicago, National Rebuilding Day is open to any community looking to be good neighbors and willing to assist with any repairs. Month” - April 29th is the official day of recognition. The group behind this effort is called “Rebuilding Together” .

THE SAIBER CONSTRUCTION LAW COLUMN By Robert B. Nussbaum, Esq.

Under New Jersey law, parties who hire independent contractor are not responsible for harm that occurs to the contractor’s employees as a result of the very work that the employee was hired to perform. In September 2022, the Court of Appeals of Maryland applied principles similar to the law of New Jersey in the context of a wrongful death action brought against, among others, the City of Baltimore after an employee of an independent contractor hired by the City was killed at the job site where he was working. In Hancock v. Mayor of Baltimore , the City had retained an excavating company to repair a clog caused by a collapsed pipe. One of the contractor’s employees died when the trench in which he worked collapsed and he was buried under tons of dirt and debris. The family of the deceased employee sued, claiming that the city was negligent in hiring the independent excavating contractor, which had violated numerous laws, regulations and industry standards in connection with the performance of the excavation work. Two lower courts in Maryland as well as the Court of Appeals (which became the Supreme Court of Maryland in December 2022), however, ruled that Baltimore was not liable. The Court stated that “one who hires an independent contractor is not liable to an employee of that contractor for injuries caused by the contractor’s negligence in performing the work for which it was hired.” The courts of New Jersey would likely have reached a similar decision if the case had occurred here. Indeed, New Jersey’s courts have already held in other cases that parties who hire independent contractors are not responsible for the harm that occurs to the

It’s pretty organic how

it all happened! My parents own and operate a construction company (Stilo Excavation) that’s been in business for over 30 years. They used roll off containers on their job sites for their own purposes, owning roughly 20 at the time. I was in college at the time, but when I graduated, my dad saw a vision for what Stilo Disposal could be. So, when I graduated from Rutgers Business School in 2017, I took over the company and grew the business from 23 dumpsters to over 100 in a few years time. What products and services does your company provide? We provide 10, 20 and 30 yard roll off containers to commercial and residential customers throughout the State of New Jersey for mixed materials such as construction debris or household cleanouts. We are also licensed to haul hazardous waste and specialize in hauling dirt and asbestos. What differentiates you from others in your industry? Our service, without a doubt. Butch Wade, our Director of Business Development and Roll Off Sales has said many times, “we provide exemplary service at fair market price” and that stands true. We are confident in our service and have many longstanding customers who can attest to that. It’s a great feeling having new customers call in based off the recommendation of a previous, or current, customer. We try to never let a service call go over 24 hours and often times can provide same day service, sometimes within only a few hours! Best Advice you have received? The best advice I have received in life and in business is to be true to yourself and focus on you (or your business in this instance). Comparison is the thief of joy. Amazing things can come from having this mindset. What do you see/believe are the most important issues in your industry today? I would say different regulations and laws that impact waste management in New Jersey, and the United States as a whole. It all has an impact on our business and how we operate as well as the costs to operate.

For example, when the gas prices were rising significantly last year, we had to implement a fuel surcharge where applicable. The impact of rising gas prices could be felt across many industries nationwide. It’s important to stay current with what’s going on in our country and around the world. What advice do you have about marketing/social media to build business? We live in such a digital world that it’s crucial to have some sort of social media presence. I love to post pictures, on Instagram especially, of our roll off trucks and containers on various job sites. It helps with brand recognition and shows our customers who we are. We are so proud of how we maintain our equipment. Our drivers (Kevin Kloza, Dave Tavarez and Troy Jackson) have a lot of pride in the trucks they drive and they wash them several times a week. Have you/your company been involved in any charitable efforts? Yes, we donate to various organizations in our community to support our youth including the South Plainfield HS Robotics Team. We also support our NJ State Police, South Plainfield Police & Fire Departments. Funniest or most surprising customer interaction? Sometimes my customers call me and tell me a joke or something funny that may have happened on their job site. I really appreciate when they do because it’s unexpected! It brings me a lot of joy to interact with our customers on a daily basis. How did you get involved with Metro initially? Butch had mentioned to me that we should look into joining Metro and I had spoken to one of our customers, Country Classics, who is also a member and from there, we decided to join! Why did you join Metro? I wanted to get more involved with legislation and impacting younger women to be in business. I feel it is so empowering to be a woman in business, especially in waste management which is predominately men. I hope to inspire others to want to be businesswomen too.

DON’T LET YOUR PROJECT GET WASTED BY POOR PLANNING By Julie Stilo, President, Stilo Disposal, IG @stilodisposal When starting a commercial or residential project, there can be an overwhelming number of factors to consider. You must order raw materials, coordinate the project schedule, and adhere to an often-strict deadline. And I am here to remind you to always include proper waste disposal in your plan! Whether you’re a residential homeowner doing your first renovation project, a seasoned builder or a commercial cleaning company, waste disposal is a critical but often overlooked component of a successful build or remodel. It’s important to consider the different ways laws and regulations can impact solid waste removal in the counties you may be building in. I have personally come across so many people in New Jersey who are unaware that disposal rules and regulations vary by county. Until I had a career in waste removal, I didn’t know either! Ultimately the disposal location can have a significant impact on the cost (time, county fees and permits, fuel) to remove mixed materials from job site. For builders in New Jersey, one important factor to consider when starting up a project is disposal costs. It’s crucial to contact a reliable disposal company. But what is a reliable disposal company? It is a company with the expertise to accurately estimate the size of your job and how many containers will be necessary. However, that is not all that your disposal company must do well. The company you hire must also be knowledgeable of the many different local laws and regulations that may impact the cost. For example, if you have been doing business in Monmouth County and are considering building in Union County, you’d want to know that the per ton cost to dispose of waste in Union County is significantly higher than Monmouth County. If you were to price out a job based on what you’re familiar with paying in Monmouth County, you’d be at a loss at the end of your project when you’ve overpaid in disposal fees, and haven’t considered pricing that into your project. Price is undoubtedly important (and maybe even the deciding factor), however service is everything. When considering hiring a disposal company to handle your roll-off containers, make sure to do your due diligence. Confirm the company is reputable and timely with their service. Butch Wade, Stilo Disposal’s Director of Business Development and Roll-Off Sales, says “if I were to give you a container at no cost to you, but didn’t service it, what is that worth?” Much success is a result of careful planning. While it is virtually impossible to plan for every scenario, it is essential that you and your company consider worst case disposal needs. Identify your waste disposal company and create a relationship today. The best way to be ready for the unexpected is to be expecting it!

SITE NOT CONDUCIVE TO SOLAR? By John Q. Martin, Construction Consultant, Roxbury High School Has the thought of installing a solar array on one of your projects, or perhaps even your personal home, crossed your mind? Do you wish to take advantage of the recently updated financial incentives for solar? Maybe you want to become more energy independent and do something good for the environment? BUT, your site has some challenges for a solar implementation. Does the property or the structure have limited southern exposure? Is it heavily shaded? Do you have limited ownership/control such as a condo situation? Fortunately, there may be a way around these challenges. In 2018, Gov. Phil Murphy signed the Clean Energy Act of 2018. This legislation mandated that the Board of Public Utilities (BPU) will create a Community Solar Energy Pilot Program. Shortly thereafter, rules and applications were published by the BPU, and a multi-year pilot program was initiated. Community solar allows existing utility customers to subscribe to the program to receive energy credits, usually at a discounted rate, from a remote solar energy project without having to install and pay for solar panels. Such solar projects, which tend to be quite large (upwards into the megawatt-range), can be found on warehouses, churches, storage facilities, and even capped-off landfills. A single solar project could be powering several hundred homes that otherwise would not have considered solar. Due to the success of the pilot program, by late 2021, BPU decided to transition the program to permanent status ahead of the 3-year pilot program timeline. In the first year of the pilot program, BPU approved 45 applications representing 78 MW of capacity. In the following year, 150 MW worth of projects were approved, which has become the benchmark annual target going forward.
